Many don’t though. In DC our local government has stopped testing for marijuana for all government positions that aren’t security-sensitive. Cops and teachers still get tested unfortunately but we’ve made some progress. At least in Minnesota, when they created the medicinal marijuana program, they also added in a clause making it illegal to fire/discipline/not hire a participant in the program for testing positive for marijuana, unless it’s a DOT thing or otherwise covered by federal law. Yes, but there are separate courts/jurisdictions and it is well known feds won’t interfere with state marijuana laws… Either way I was only suggesting an argument could be made in court.

For Official Heart Love. Everyone Shirt. It’s not as cut and dry as tobacco use for example. Exactly. I don’t think teachers should be dinged for such things unless there is reason to believe they’re high during class. But in many factory jobs or construction or other dangerous jobs? Absolutely. A lot of companies in states that are now recreational are still requiring you to take a drug tests. Also despite it’s medical benefits some states are just treating it like they do alcohol. Some don’t test for it now. But if it was legalized federally for recreational use they would still be able to drug test for it. Someone said certain states have passed laws that ban employers from testing for legal substances (tobacco, alcohol), but my guess is that there are a lot of exceptions in those laws. You’d have to look at each state’s laws individually.
